How to Respond to a Subpoena for an Employee’s Records

There are many reasons why a subpoena or other request for records may cross your desk. Disputes between employees and management can quickly become litigious and complicated. Employee records are often requested when claimants assert lost wages or loss of earning capacity. An employee’s records may include protected health information, personally identifiable information, or other information implicating privacy rights. What are the first steps you should take? What are the most likely areas for risk to you, and at what point should you bring in outside counsel?
