In this session, Baker McKenzie's Partners, Anne-Marie Allgrove and Paul Forbes, will provide an update on the latest developments in relation to data breaches including:
•    how the landscape and guidance has changed following the introduction on mandatory reporting in 2018
•    trends and observations in relation to reported data breaches in Australia
•    developing obligations in other jurisdictions and the impact of those changes in Australia.

Anne-Maria and Paul will also discuss how this impacts your business, including: 
•    the benefits of developing a Data Breach Response Plan
•    controlling and protecting information shared with contractors and service providers
•    managing a data breach in the context of mandatory disclosure
•    what should your contract say?
•    what should your data breach response plan say?
•    how you can ensure that claims for legal professional privilege are preserved.

Anne-Marie Allgrove, Partner

Anne-Marie has a broad commercial practice with particular focus on issues in the technology, payments, and healthcare industries. She is also an expert on privacy related issues including data protection, security and information management across all industries and is one of the leading lawyers in relation to privacy in Australia. Anne-Marie's clients include a range of technology companies, payments organisations, pharmaceutical and health care companies, consumer and retail businesses and luxury brands.

Anne-Marie has extensive experience advising on complex transformational technology and sourcing arrangements and sponsorship, marketing and promotional arrangements.

 

Paul Forbes

Paul Forbes, Partner

Paul acts in complex commercial disputes before state, federal and appeal courts in relation to claims for negligence, misleading conduct and other contraventions of trade practices legislation, breach of contract, judicial review, equitable relief, fraud, white-collar crime, data and cyber-security.

Paul also has significant experience in class actions, financial services, disputes related to business sale and purchase contracts, supply and distribution contracts, franchising agreements and the use and misuse of confidential information.
