FTC Proposes Sweeping Federal Ban on Employee Noncompetes

On January 5, 2023, the Federal Trade Commission (FTC) announced a proposed regulation that, if adopted, would essentially abolish employee noncompetes across the United States. A proposed FTC regulation on employee noncompetes has been anticipated since July 2021, when President Biden signed an Executive Order calling on the FTC to exercise its “statutory rulemaking authority under the Federal Trade Commission Act to curtail the unfair use of noncompete clauses and other clauses or agreements that may unfairly limit worker mobility.”  Read more.

Last year, private equity firms spent US$51 billion on sports transactions, including US$3 billion in minority stakes in North American teams.
In 2021, Craig and Mark advised National Hockey League (NHL) team Tampa Bay Lightning, and its owner in one of the first private equity investments in NHL history. In addition Mark advised Major League Soccer (MLS) team Inter Miami CF and its majority owners in connection with their recapitalization. The recapitalization featured an equity investment by Ares Capital and represents the first-ever private equity investment in any MLS team. Hogan Lovells also advised Arctos Sports Partners on its acquisition of a minority interest in National Basketball Association (NBA) team Golden State Warriors in the first transaction in the NBA involving a private investment fund, as well as NBA team San Antonio Spurs in a strategic investment from Sixth Street Partners, a leading global investment firm.
