On July 1, new Spanish bar regulations impacting legal professional privilege will go into effect.

The new regulations add flexibility to the practice of law and explicitly equate in-house counsel with lawyers who practice in law firms as employees or partners. This treatment is familiar for lawyers who practice in the United States, where they are accustomed to the same rights and obligations as those who work in law firms. However, in many countries, there is a difference in education and bar membership between the two forms of practice. The new Spanish regulations are part of an evolving trend whereby in-house lawyers are increasingly acting as trusted business partners who maintain compliance in their companies and intervene to prevent or remedy deviations.
